The City of Springfield is a public governmental body subject to the requirements of the “Sunshine Law” with regard to the release, or public disclosure, of documents submitted to the City to third parties who request it. If the material would have been open if not submitted through ePlans, it will be open when submitted through ePlans. The disclosure required by law may include some of your personally identifiable information or regarding your project. The City’s forms indicate the information required to be submitted for your application to be considered.
EPlans is a service provided through a program called “Project Dox” and is offered as a convenience to persons seeking to have plans and specifications for projects reviewed electronically and to receive comments back from staff in a convenient written form. Submissions become subject to state law on open records and access by the public unless closed by other law or specific exceptions to such a release or disclosure. If you believe your submittal is protected by law from release to third parties, you need to note that on your drawings, applications and other documents considered by you to be closed or privileged and the basis for such notation. The City will make every effort to review any request for disclosure or release of your documents and submittals to determine in light of such notations and determine the status of the documents in its opinion as to whether or not it is open or closed within the meaning of Chapter 610, RSMo. The City will use its best efforts to avoid release of records and submittals to those not authorized or entitled to review or see them, but it cannot guarantee that someone may see a submittal that they should not have had access to. The City cannot be responsible for inadvertent or mistakes in release of your documents to third parties and accepts no liability for such disclosure. HOWEVER IT SHOUL D BE NOTED THAT IF THE PROPEROTY OWNER REQUESTS ACCESS TO SUBMITTALS SUCH ACCESS WILL BE GRANTED UNLESS PROHIBITED BY SPECIFIC LAW WHICH HAS BEEN IDENTIFIED AT THE TIME OF SUBMITTAL.
